Cuprio Terms of Use

These Terms govern the use of the "Cuprio" application provided by misty-egg Y.K. ("we," "us," or "our"). By downloading or using the app, you agree to these Terms.

1. Usage

We grant you a personal, non-exclusive right to use the app in accordance with these Terms. The app is distributed through Apple's App Store, and Apple's terms apply to purchases, billing, and refunds.

2. Application Features

Cuprio provides calculator functions, time calculations, history storage, and background customization features.
User settings and selected background images are generally stored locally on the device. See the Cuprio Privacy Policy for details.

3. Disclaimer of Warranty

The app is provided "as is." We use reasonable efforts to maintain quality but, except where required by law, do not warrant accuracy, completeness, fitness for a particular purpose, uninterrupted availability, absence of defects, or compatibility with every device or OS. Results are calculated from the values entered by the user and the selected calculation mode, tax rate, rounding method, number of decimal places, and other settings. Even when the app operates correctly, an entry or setting may produce a result different from what the user intended. Before calculating and before relying on a result, the user must confirm that all entries and settings are suitable for the intended purpose. The app does not provide tax, legal, financial, or other professional advice.

4. Prohibited High-Risk Uses

The app is intended for general everyday calculations. It is not designed or validated for medical treatment, medication dosage, life support, safety management, emergency response, architectural or structural calculations, vehicle or machinery control, hazardous materials, or any other decision involving human life, physical safety, or substantial property damage. Do not use the app for these purposes. Calculations requiring professional judgment must be verified by a qualified professional and an approved system intended for that field.

5. Limitation of Liability

We are not liable for loss caused by an incorrect entry, an incorrect calculation mode, tax rate, rounding method or other setting, or failure to verify a result where we are not at fault. Except for our willful misconduct or gross negligence, we are not liable for special, indirect, or consequential damages or lost profits arising from use or inability to use the app. Where loss results from our ordinary negligence, our total liability is limited to direct and ordinary damages actually incurred and will not exceed US$50 or the equivalent amount in the user's country of residence. This cap does not apply to our willful misconduct or gross negligence, death or personal injury, or where applicable law does not permit the limitation. Mandatory consumer rights remain unaffected.

6. Stored Data

We do not guarantee the preservation of stored data such as calculation history, settings, or background images.
Data may be lost through device failure, deletion, device replacement, or OS changes. Keep a separate record of important information. We do not guarantee preservation or restoration through Apple or device backup services.

7. Photos and Image Files

Users are responsible for obtaining any necessary rights or permissions related to images used as custom backgrounds.

8. Restrictions

You must not violate law or third-party rights, tamper with the app, reverse engineer it beyond what applicable law permits, redistribute it without authorization, compromise security, or interfere with its operation.

9. Changes to Terms

We may revise these Terms to reflect changes in law, app features, or operational needs. Material changes will be clearly announced on this page or in the app. If any provision is invalid, the remaining provisions remain effective.

10. Changes or Discontinuation

We may change, suspend, or discontinue app features for maintenance, technical, or business reasons. Where practicable, we will provide advance notice.

11. Relationship with Apple

These Terms are between you and us, not Apple. Apple is not the provider of the app. To the extent required by applicable law, we are responsible for the app, maintenance, support, product claims, and intellectual-property claims. You must comply with App Store terms and other applicable third-party agreements. Apple and its subsidiaries are third-party beneficiaries of these Terms.

12. Governing Law, Jurisdiction, and Language

These Terms and the app are governed by Japanese law. Where permitted by law, the Yokohama District Court or Kamakura Summary Court shall be the agreed court of first instance for disputes concerning the app or these Terms. Mandatory consumer rights remain unaffected. If the Japanese and translated versions differ, the Japanese version controls to the extent permitted by law.
